1. About These Terms

These Terms and Conditions ("Terms") govern your use of the Zoom Tyres website (zoomtyres.co.nz) and any purchases made in-store or online. By placing an order or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Zoom Tyres is operated from 33d Great South Road, Ōtāhuhu, Auckland 1062, New Zealand.

2. Consumer Guarantees Act & Fair Trading Act

Our products and services come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986. You are entitled to a repair, replacement, or refund for a failure, and compensation for other reasonably foreseeable loss or damage. If the failure is significant, you may reject the goods and receive a full refund or replacement.

Nothing in these Terms is intended to limit or exclude your rights under New Zealand consumer law.

Note for business purchasers: If you are purchasing goods for business purposes, you may agree to opt out of the Consumer Guarantees Act in accordance with section 43 of that Act. Please advise us at time of purchase if this applies.

3. Pricing & Payment

• All prices are displayed in New Zealand Dollars (NZD) and include GST unless otherwise stated.
• Prices are subject to change without notice. The price charged will be the price confirmed at the time your order is placed.
• We accept payment by credit/debit card, bank transfer, Afterpay, and Genopay. Third-party payment providers are subject to their own terms and conditions.
• We reserve the right to cancel any order where a pricing error has occurred.

4. Online Orders & Shipping

• Orders are processed once payment is confirmed.
• We aim to dispatch in-stock items within 2–5 business days. Delivery times may vary depending on your location within New Zealand.
• Risk in goods passes to you upon delivery. Please inspect all items upon receipt and contact us promptly if there is damage or a discrepancy.
• Zoom Tyres currently ships within New Zealand only.

5. Fitment & In-Store Services

Professional tyre fitting, balancing, and alignment services are performed at our Ōtāhuhu workshop.

It is your responsibility to provide accurate vehicle information (make, model, year, and stud pattern) when ordering wheels or tyres. Zoom Tyres accepts no liability for incorrect sizing resulting from inaccurate information provided by the customer.

We strongly recommend verifying compatibility using your vehicle's tyre placard or owner's manual before purchasing.

6. Returns & Refunds

• Change of mind: We do not offer refunds or exchanges for change of mind on correctly supplied goods. Please choose carefully.
• Faulty or incorrectly supplied goods: Where goods are faulty, damaged in transit, or not as described, we will remedy the situation in accordance with the Consumer Guarantees Act — either by repair, replacement, or refund at our discretion.
• Fitted tyres: Tyres that have been fitted and driven on cannot be returned unless they are faulty.

To initiate a return, contact us at admin@zoomtyres.co.nz within 7 days of receiving your order, with proof of purchase and photos where applicable.

7. Warranty

• Products are covered by the manufacturer's warranty where applicable.
• Our fitting workmanship is guaranteed. If you experience an issue related to our service, please contact us so we can assess and resolve it.
• Warranties do not cover damage caused by accidents, misuse, improper installation by a third party, or failure to maintain tyres within recommended operating pressures and conditions.

8. Limitation of Liability

To the maximum extent permitted by law:

• Zoom Tyres' liability for any claim arising from a product or service is limited to the purchase price of the product or service in question.
• We are not liable for indirect, consequential, or incidental loss (including loss of income or vehicle downtime) unless required by the Consumer Guarantees Act.

9. Intellectual Property

All content on zoomtyres.co.nz — including text, images, logos, and product descriptions — is the property of Zoom Tyres or its licensors. You may not reproduce, distribute, or use this content without prior written permission.

10. Website Use

You agree not to misuse our website, including attempting to gain unauthorised access, introduce malicious code, or disrupt its operation.

We make no guarantee that the website will be available at all times and accept no liability for interruptions or errors.

11. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
